We may have to share your personal data (for the purposes set out in the table above explaining our use of your personal data) with external third parties who perform certain functions on our behalf or provide us with services to enable us to deliver our services and manage our business.
The services these third parties provide include our business management system, our IT support and service providers, including payment processing and debt collection services and professional advice such as legal, tax and accountancy.
We may also share personal data with national governing bodies, regulatory associations and other similar organisations in connection with the tuition subject you /student is receiving.
We may also need to share your personal data with HM Revenue and Customs and other regulatory authorities.

We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

We take the steps required by data protection law to protect your personal information to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. You confirm that by accessing the services on this website that you are over the age of 18. You confirm that you are solely responsible for your health and safety during your access of the services. You access the services at your own risk and you understand that they may be physically strenuous, and you voluntarily participate in them with full knowledge that there is risk of personal injury. You also understand that any instructors providing the services may not be able to see or guide your participation in the services.
You take full responsibility for your actions during access to the services. To the fullest extent permitted by law, we shall not be liable in contract, tort, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature whatsoever incurred or suffered by you or any minor in your care, except in the case of death or personal injury caused by our negligence or fraud.

3.0 SILVER SAMURAIS ACCOUNT INTEGRITY
As part of the registration process you will need to create an account, including a username & password and agree to these Terms and our Privacy Policy in order to use the features of Silver Samurais website.
It is your responsibility to ensure that the information you provide is accurate and not misleading. You cannot create an account or username & password using the names and information of another person or using words that are the trademarks or the property of another party or vulgar, obscene or in any other way inappropriate. You are responsible for maintaining your own username and password via our website. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.
You are responsible for your customer account and any actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.
You may not share your Silver Samurais account with anyone else. Please keep your password confidential. If you believe that your account has been compromised at any time, please reset your password in your Silver Samurais account.
4.0 YOUR SILVER SAMURAIS MEMBERSHIP
When you place an order to become a member, you will automatically receive a confirmation email from us to confirm your membership order. Your membership order constitutes an offer made to us to purchase a service or product. Your offer is only accepted by us once we have emailed you to confirm the creation of your account and your username & password details and the service or product has been provided to you.
We reserve the right to delay or refuse orders where a transaction contains incomplete details or details that cannot be verified or where fraud is suspected.
If we are unable to reasonably ascertain these details or resolve these issues a full refund will be made against the card used at the time of purchase. No other form of refund or credit will be offered nor will a refund be made to any third party card or account.
Monthly Membership
If you are a monthly member, you will be billed on a month-to-month basis, renewing automatically unless you cancel your membership, as described below, or we terminate it. If you cancel after any payment, your membership will continue until the end of that month. Details regarding your membership are available on your Silver Samurais account you created with your user name & password as part of the registration process.
Annual Membership
If you are an annual member, you will be billed once for a 12-month membership, renewing annually unless you cancel your membership, as described below, or we terminate it. If you cancel after your payment, your membership will continue until the end of the 12-month period. Details regarding your membership are available on your Silver Samurais account you created with your user name & password as part of the registration process.
Payment
Memberships require Internet access and a current, valid, accepted method of payment on file with your Silver Samurais account (“Payment Method”) that will be billed automatically each month. Please monitor your Payment Method to ensure that it remains current. If your Payment Method expires, your membership will automatically be cancelled fourteen (14) days after your original payment due date.
Cancelling Your Membership
You can cancel your membership at any time when you are logged into your Silver Samurais account you created with your user name & password as part of the registration process.
You can also cancel your membership at any time by contacting us at info@silversamurais.com with your membership details.
5.0 PAYMENT
Payment for product or service is made online via ‘Stripe’ payment processing platform using MasterCard, VISA and Maestro.
Payment for your order is taken at the time your order is placed. The currency used is in British Pounds (£/GBP). VAT is included in all our prices.
If you are placing an order using a card which is not denominated in British pounds (£/GBP) your card issuer will calculate the applicable exchange rate to process the transaction. We are not responsible for any exchange rates.
You are required to provide payment details that are valid and correct and you confirm that you are the person referred to in the billing information provided.
6.0 CANCELLATION & REFUNDS
Where your access grants you immediate access to any downloadable, electronic or “softcopy” goods or other electronic services of immediate value you will be required to tick the box at the checkout waiving your right to a refund under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
No refunds are given if the training is not taken and there are no refunds for any partially-used periods.
In the case of a defective service we reserve the right to offer a free period of service or issue a partial or full refund at our sole discretion.
Where a refund is offered and accepted by you it will be made within seven working days of receiving your acceptance of a refund. You will be notified by Silver Samurais via e-mail once your return has been processed.
Once a refund is issued your access will be terminated. Any content or data in your account will be deleted.
7.0 LICENCE
We grant you a licence to access the content, information and services contained within our website for consumer use only.
This licence does not allow you to make our website available via an intranet, where our website or a substantial part of it is hosted locally on the intranet in question.
Our website design, layout, content or text cannot be copied, edited or otherwise manipulated without our express prior written permission.
Our website cannot be placed within the frame-set of another website.
Third parties are not allowed to “deep link” to pages within our website, without our express prior written permission. All links (unless expressly permitted by us) should be to the main index page of our website.
Furthermore, the content of such links, whether graphic or text should not be misleading, false, derogatory or in any other way offensive.

Silver Samurais is subject to copyright, please don’t share it on the internet or give unauthorised access to your silver samurais online account with anyone.
All copyright in the content, databases, graphics, buttons, icons, logos, layouts and look & feel belong to us and our sub-contractors, unless expressly acknowledged as otherwise.
The data mining, extraction or utilisation of product information from our website is not permitted without our express prior written permission.
9.0 THE CONSUMER RIGHTS ACT 2015
These Terms & Conditions are specifically written in accordance with the Consumer Rights Act 2015. Should these Terms & Conditions conflict with the Act, the Consumer Rights Act 2015 shall prevail and apply. Where acting as a consumer your statutory rights are unaffected.
10.0 STRIPE PAYMENT PROCESSING
Our card payment services are processed by Stripe which allows us to (a) accept payment by authorised credit and debit card transactions, and (b) have those funds deposited into our designated bank account.
In the event of any refund that you believe is due under our refund policy (as set out above in these terms and conditions), you may request that Silver Samurais initiate a refund by contacting us by email: info@silversamurais.com
Silver Samurais will review the facts and circumstances and determine whether or not a refund is due in accordance with our refund policy within 30 days of being contacted by you.
11.0 HEALTH STATEMENT
These products are not intended to diagnose, prevent, treat, or cure any disease or condition.
SIMPLE TERMS : You are responsible for yourself when you exercise at home. Ask your doctor first if you have any concerns or medical conditions.
Exercise carries its own risks. Your health is your responsibility and we ask that you do not exercise beyond your own abilities or carry out activities which you know or believe to be unsuitable for you. There may be risks associated with participating in activities mentioned on silversamurais.com for people in poor health or with pre-existing physical or mental health conditions. Because these risks exist, you should not participate in such plans or programs if you are in poor health or have a pre-existing mental or physical condition. If you choose to participate in these risks, you do so of your own free will and accord, knowingly and voluntarily assuming all risks associated with such physical activities. These risks may also exist for those who are currently in good health right now.

The Martial Arts College Ltd (t/a Silver Samurais) advises you obtain a comprehensive physical examination by a licensed physician/doctor/physiotherapist PRIOR to undertaking any exercise or training demonstrated on this website, and/or any of videos offered on this website.
You fully assume the risk of any resulting injury. Such injuries include but are not limited to: bruising, cuts and general soreness, muscle and tendon injuries, ligament and skeletal injuries, fractured or broken bones, concussions, cardiovascular complications.
